Money Transfer Terms and Conditions

1. About these terms

These Terms and Conditions ("Terms") govern the money transfer services provided by BR Corporation SA, operating under the brand Via Express ("Via Express", "we", "us", "our"), to you, the customer ("you"). By registering, placing a transfer order, or using our services through any channel (agency, WhatsApp, website, mobile application or call centre), you agree to these Terms.

Please read them carefully. If you do not agree, do not use the service. These Terms should be read together with our Privacy Policy.

2. Who we are and our role

Via Express is a money transfer brand operated by BR Corporation SA, a company based in Switzerland, at Rue de Chantepoulet 8, 1201 Genève (commercial register CH-660.2.546.013-1). We are affiliated with PolyReg, a self-regulatory organisation supervising money transfer operators in Switzerland, and we comply with the Swiss Anti-Money Laundering Act.

Via Express acts as an intermediary that arranges international money transfers. The payout to the beneficiary at the destination is processed through our partner Swiss Money Corp and its paying network. We are responsible for our part of the service; the final payout depends on the partner and paying agents in the destination country.

3. Definitions

  • Transfer: an instruction from you to send a sum of money to a beneficiary.
  • Beneficiary: the person or entity designated by you to receive the funds.
  • Transfer code: a reference we may issue so the beneficiary can collect the funds.
  • Business day: a day on which banks are open in Switzerland, excluding public holidays.

4. Eligibility

To use our services, you must be at least 18 years old, have full legal capacity, and act on your own behalf and for lawful purposes. We may refuse to open a relationship or to execute a transfer at our discretion, in particular where required to comply with our legal and regulatory obligations.

5. Registration and identity verification (KYC)

Before we execute certain transfers, and as required by law, you must register and provide valid identification and any information we request to verify your identity and the purpose of the transfer. You can register in one of our agencies or through the channels we make available.

You agree to provide accurate, complete and up-to-date information, to present a valid identity document, and to inform us of any change. We may verify your information against third-party and official databases. We may refuse, suspend or limit the service if we cannot verify your identity or if information is missing, inaccurate or suspicious.

6. How the service works

You can send a transfer through any of our channels: in one of our agencies, on WhatsApp, online, through the ViaExpress app, or via our call centre.

To place a transfer, you provide the amount, the destination, the beneficiary's details, and the way the beneficiary should receive the funds. We confirm the exchange rate, the fee and the total before you authorise the transfer. Once you authorise and pay, we process the transfer.

For collection in cash, we may issue a transfer code that you must share with your beneficiary. You are responsible for keeping the transfer code and the beneficiary's details confidential and for sharing them only with the intended beneficiary.

7. Exchange rates and fees

The exchange rate and the fee applicable to your transfer are shown to you before you authorise it. Any exchange rate shown as indicative (for example, in the online calculator) may differ from the final rate, which is the rate confirmed at the moment you send. Rates fluctuate with the market.

The total cost of your transfer is the amount sent plus the applicable fee, at the confirmed exchange rate. We do not add hidden charges. Depending on the destination and the receiving method, the beneficiary's bank or paying agent may apply its own charges, which are outside our control.

8. Payment methods

You can pay for your transfer by card, cash, bank deposit or bank transfer, online or in our agencies, as available for your transfer. We begin processing once we have received cleared funds and completed any required checks.

9. Limits

Transfer amounts are subject to limits set by us and by law, which may vary by customer, channel, destination and verification level. The limits that apply to your transfer are shown to you before you send. We may adjust limits and request additional information for larger or unusual transactions in order to meet our legal and compliance obligations.

10. Execution and timing

Most transfers are available within minutes, but delivery times depend on the destination, the receiving method, the paying agent, and any checks we are required to perform. Cash collection may be available immediately or on the following day depending on the destination. We are not responsible for delays caused by incomplete or incorrect information, by the beneficiary's bank or paying agent, by compliance checks, or by events beyond our control.

11. Receiving the funds

Depending on the destination country, the beneficiary may receive the funds into a bank account or as cash collection at a partner location. It is your responsibility to provide accurate beneficiary details. We are not responsible for funds paid to a person who presents the correct details or transfer code, or for funds sent to an incorrect account due to details you provided.

12. Cancellation, refunds and corrections

You may request to cancel a transfer before the funds have been made available to the beneficiary. If the funds have not yet been paid out, we will refund the amount sent. Fees are refunded only where the transfer has not been executed or where the law requires otherwise. Refunds are made to you, using the original payment method where possible, in the currency you paid.

If you notice an error in the details you provided, contact us immediately. We will make reasonable efforts to help, but we cannot guarantee recovery of funds already paid out based on the details you provided.

13. Your obligations and prohibited use

You agree to:

  • use the service only for lawful purposes and on your own behalf;
  • provide accurate and complete information;
  • not use the service for any illegal activity, including money laundering, financing of terrorism, fraud, or the evasion of sanctions;
  • not send funds on behalf of an undisclosed third party;
  • comply with these Terms and with applicable law.

We may refuse, suspend, delay, freeze or reverse a transfer, and close your relationship with us, where we reasonably suspect a breach of these obligations or where required to comply with our legal and regulatory duties.

14. Anti-money-laundering and sanctions

We are legally required to identify customers, monitor transactions, and report suspicious activity to the competent authorities. We may delay, decline, freeze or report a transaction to comply with anti-money-laundering, counter-terrorism-financing and sanctions obligations, and we may be prohibited by law from disclosing the reason. We are not liable for any loss arising from action taken to comply with these obligations.

15. Fraud prevention and your security

Never send money to someone you do not know or trust, and be cautious of anyone who pressures you to send funds urgently, for a prize, a job, an investment, a romance, or an emergency. Once funds are collected by a beneficiary, a transfer generally cannot be reversed. Keep your transfer code and account details confidential. If you suspect fraud, contact us immediately.

16. Liability

We provide our services with reasonable care and skill. To the extent permitted by law, we are not liable for:

  • delays or failures caused by incorrect or incomplete information you provide;
  • the acts, charges or delays of the beneficiary's bank, paying agent or any third party;
  • delays or refusals resulting from our legal and compliance obligations;
  • events beyond our reasonable control (force majeure), including outages, natural events, strikes, or acts of authorities;
  • indirect or consequential loss.

Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited by law. Our role is that of intermediary, and the final payout is processed by our partner Swiss Money Corp and its paying agents.

We handle complaints with care and aim to respond as quickly as possible. If a complaint cannot be resolved directly with us, you may refer it to our self-regulatory organisation, PolyReg General Self-Regulatory Organisation.

18. Data protection

We process personal data in accordance with our Privacy Policy, which explains how we collect, use, share and protect your data, and your rights. Please review it before using our services.

19. Changes to these terms

We may update these Terms to reflect changes in our services or in the law. The version in force is the one published on our website at the time you place a transfer. Where changes are significant, we will take reasonable steps to inform you. Your continued use of the service after an update means you accept the updated Terms.

20. Governing law and jurisdiction

These Terms are governed by Swiss law. Any dispute arising from or in connection with them is subject to the exclusive jurisdiction of the courts of Genève, Switzerland, subject to any mandatory consumer-protection rules that may apply to you.
